What to do if the Repossession process has started

If you are facing repossession, you need to know what you should do.

The first you need to know that you are not the only one in the UK or any other country that is going through this exact same thing. It's a difficult situation and can become very stressful. So you need to try to relax so you can figure out what your next step is going to be.

It's important that you understand your rights as well as the process of repossessions. The lender is not able to repose your home until you have a court hearing and a judge agrees that the lender should take back ownership of the home. At court you will have the chance to explain your situation to the judge. There is a small chance that the judge may have some compassion if there is children involved and you may be able to get a extension date for the Order for Possession, which is usually 28 days. Since there are many steps in the process of repossession you have time to correct the situation if possible.

Let's look at what you can expect when your lender has begun the process:

First you are going to begin receiving a slew of payment reminders, and you should not ignore these letters. Call your lender and inform them of your situation and see if you can come up with some sort of agreement. The best thing that you can do is call up the lender and talk to them, they don't want to reposes your home and are not interested in home foreclosure, but they will if they are left with no choice. So if you talk to them, depending on your lender they may be willing to hear your situation. They may offer you repayment plans for the money you own or a short-term reduction of your monthly payment, this is less common, but not unlikely. But you won't know unless you speak to them. It's worth a shot and if they say no you are not any worse off then you are right now.

If you are four to six months behind on your mortgage then you will then begin to get letters from solicitors, and these letters are going to be demanding the payment in full. And if you don't bring your account current then they are going to go forward with the repossession proceedings. At this point you still have the chance to work with them. Make the necessary attempts to make payment arrangements, and if you are able you should be making your regular monthly payments to show that you are attempting to make things right.

Next is the start of the repossession proceedings, and this is when the court proceedings will begin, and it's important that you are present at these hearings. At this possession hearing the judge will make the decisions to give you a new hearing, Dismiss or Adjourn indefinitely, issue an Order for Possession, or Suspend an Order for Possession.

Now depending on the judge's order you will either have to vacate the property or you will be given another chance. If you do not leave the property on the date that the judge ordered then they will come and take your possession of the property and they will change the locks.
